Terms of Service
Please review our hosting terms carefully before using the service.
1. Resource Usage & Acceptable Use Policy (AUP)
1.1. Network Traffic Limit: Your plan includes 1.5 TB of monthly network traffic. If your game server or website exceeds 1.5 TB in a month, the provider reserves the right to temporarily pause/throttle your service or charge standard overage fees for the extra data used.
1.2. Fair CPU Usage: To ensure all servers run smoothly, your website or game server is permitted to use its allocated resources normally. Short spikes up to 99% CPU usage (e.g., during server startup, restarts, or loading maps) are perfectly fine! However, sustained usage at this high level for multiple minutes or hours is considered resource abuse. In such cases, the provider reserves the right to limit, throttle, or temporarily pause your service to protect other users on the network.
1.3. Prohibited Usage: It is strictly prohibited to use our services for:
- Cryptocurrency mining (Crypto Mining).
- DDoS attacks, port scanning, malware distribution, or botnets.
- Hosting or distributing copyrighted material (e.g., pirated content/torrents).
2. Payments, Cancellation & Refunds
2.1. Our Pricing Goal: We operate on a non-profit basis and reinvest all revenue to cover our underlying infrastructure expenses and provide the lowest possible prices.
2.2. Right to Adjust Prices: Since infrastructure and licensing fees from our upstream providers may fluctuate, we reserve the right to adjust service prices when necessary to cover external backend costs. Customers will be notified of any price changes prior to their next billing cycle.
2.3. No Right of Withdrawal or Refunds: Because our digital services are ordered and provisioned immediately through external upstream providers, the standard right of withdrawal for digital content is waived upon completed purchase (in accordance with EU consumer regulations). No refunds or partial refunds are provided for active billing cycles or early cancellations.
2.4. Payment Disputes (Chargebacks): If a customer initiates a payment dispute or chargeback via their bank/card issuer without contacting our support first, we reserve the right to immediately terminate the account and permanently delete all associated data and servers.
2.5. Overdue Payments: If an invoice is not paid by the due date, the server will be automatically suspended after 3 days. If payment is still not received after 7 days, the server and all associated data will be permanently deleted.
3. Backups & Data Protection
3.1. Your Data, Your Responsibility: We provide 3 automated backups stored safely on an external S3 backup server in Germany as a free bonus feature. However, tech can fail. You are always responsible for keeping your own local backups of your game worlds, player files, and website databases.
3.2. No Liability for Data Loss: If a major hardware failure, cyberattack, or system corruption happens to our backend infrastructure and data is lost, the provider cannot be held financially or legally responsible for any lost data, website downtime, or lost game progress.
4. Network Protection (DDoS) & Availability
4.1. Layer 4 to Layer 7 Protection: All our web and game hosting services come with automated Layer 4 to Layer 7 Enterprise DDoS protection. Attacks are automatically detected and blocked in real-time.
4.2. Limitation of Control & Attack Escalation: In the rare event that an advanced or massive attack bypasses the filters and affects your server, we cannot prevent or stop it directly. Our role in these situations is to immediately escalate the issue and contact our higher infrastructure providers to resolve the attack at the network edge. The provider is not liable for temporary downtime caused by these external attacks.
4.3. Availability & Maintenance (SLA): We strive for maximum uptime but do not guarantee 100% continuous availability. We reserve the right to perform scheduled maintenance (e.g., security updates and hardware upgrades). Customers will be notified of scheduled maintenance in advance whenever possible.
5. Local Laws & Data Jurisdiction
5.1. Compliance with Hosting Laws: Customers are strictly required to comply with the local laws of the country where their server is physically hosted:
- For services hosted in Frankfurt, customers must comply with German server and digital laws (including Telecommunications acts).
- For services hosted in Amsterdam, customers must comply with Dutch/Netherlands server and internet legislation.
5.2. Illegal Content: Any hosting of content, tools, or data that violates German or Dutch law will result in an immediate and permanent suspension of the service without notice or refund.
6. GDPR & Privacy Policy (Data Protection)
6.1. Collection of Personal Data: We only collect necessary information required to process your order and manage your account (such as email address, IP address, and billing information via Stripe). We never sell your data to third parties.
6.2. Data Misuse and Game Servers: As the owner of a game server or website hosted with us, you are the "Data Controller" for any data your own players or visitors leave behind (e.g., IP addresses in log files or usernames). You must ensure you do not collect data in violation of GDPR.
6.3. Storage Within the EU: All customer data and your 3 automated backups are stored on secure servers located within the EU (Germany and Amsterdam), fully complying with GDPR standards. If you terminate your service, your backups and log files will be automatically deleted after your contract expires.
7. Force Majeure & Account Termination
7.1. Uncontrollable Events: We are not responsible for any service interruptions, downtimes, or failures caused by events completely outside of our control. This includes acts of war, military conflicts, national emergencies, natural disasters, or major international internet infrastructure blackouts.
7.2. Termination: We reserve the right to terminate your service immediately and without a refund if you use your hosting for illegal activities, hacking, or anything that intentionally harms our network.
8. Age Limit & Modifications
8.1. Age Limit: You must be at least 18 years old (or have parental/guardian consent) to purchase services and enter into an agreement with us.
8.2. Terms Modifications: We reserve the right to update these terms at any time. Continued use of our services following any updates constitutes acceptance of the new terms.
